To protect jobs and ensure the economic survival of the company, the German federal government, in the form of the Federal Employment Agency, steps in with the short-time work allowance. However, applying for short-time work benefits is associated with risks under criminal law. In Germany, the offense of subsidy fraud under § 264 of the German Criminal Code (StGB) can occur in the case of:
- incorrect or incomplete information is provided to the competent authority
- Non-compliance with restrictions on use
- Deception regarding facts relevant to subsidization
- Use of incorrect or incomplete certificate
An efficient and structured regulation and documentation of working hours and the presence of your employees is therefore all the more important. The better your overview of the working hours of your employees, the better you have the legal risks under control.
